Agreement to Terms

User Responsibilities

By using our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not attempt to interfere with or disrupt our services
• Respect intellectual property rights
• Comply with all applicable laws and regulations
• Not use our services to transmit harmful, offensive, or illegal content

Service Packages

• All service packages require a signed agreement before work begins
• Payment terms are typically 50% upfront, 50% upon completion
• Custom projects may have different payment schedules as agreed
• All prices are in USD unless otherwise specified

Virtual Live Classes

• Payment is required before class enrollment
• Refunds available within 7 days if no classes have been attended
• Make-up sessions available for missed classes with 24-hour notice
• Class materials and recordings remain accessible for 90 days post-completion

Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, and AI models, are owned by Melanin Tech & AI Solutions and are protected by copyright, trademark, and other intellectual property laws.

Client Work Product

• Custom software and solutions developed for clients become client property upon full payment
• We retain the right to use general methodologies and know-how for future projects
• Client data and confidential information remains client property
• We may showcase completed work in our portfolio with client permission

Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service availability. Scheduled maintenance will be communicated in advance when possible.

AI and Automation Disclaimer

Our AI solutions are designed to assist and enhance business operations. However:

• AI responses may not always be 100% accurate
• Human oversight is recommended for critical business decisions
• We are not liable for decisions made based solely on AI recommendations
• Results may vary based on implementation and usage

Limitation of Liability

To the maximum extent permitted by law, Melanin Tech & AI Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Cancellation and Refunds

Service Packages

• Cancellation must be requested in writing
• Refunds for work not yet completed may be available at our discretion
• Completed work and delivered solutions are non-refundable
• Custom development projects have specific milestone-based terms

Virtual Live Classes

• Full refund available within 7 days if no classes attended
• Partial refunds may be available for unused sessions
• No refunds after 50% of classes have been completed

We understand that you may share confidential business information with us during consultations and project development. We commit to:

• Maintaining strict confidentiality of all client information
• Using information only for the purpose of providing services
• Implementing appropriate security measures to protect data
• Not disclosing information to unauthorized third parties
• Returning or destroying confidential information upon request

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved through binding arbitration in San Francisco, California.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.
